Terms and Conditions

These Terms and Conditions (the "Terms") govern your use of the mobile games, apps, websites and related services (together, the "Service") provided by OZD Teknoloji ve Danismanlik ("OZD", "we", "us" or "our"), including Beauty Smash. By downloading, installing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old, or the minimum age required in your country to consent to the use of online services, to use the Service. If you are under the age of legal majority where you live, you may only use the Service with the consent of a parent or legal guardian, who agrees to these Terms on your behalf. We may ask for confirmation of age and may restrict access where we believe these requirements are not met.

2. Your Account

Some features may require an account or may link your progress to your device or platform account. You are responsible for keeping your login details secure and for all activity under your account. Please keep your information accurate and up to date. You can ask us to close your account at any time by emailing info@ozdconsult.com.

3. App Store and Platform Rules

The Service may be distributed through third-party platforms such as the Apple App Store and Google Play. Your use of the Service is also subject to the terms of those platforms. Where you download the Service from the Apple App Store, you acknowledge that these Terms are between you and OZD only, not Apple, and that Apple has no obligation to provide maintenance or support for the Service. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

4. Virtual Items and In-App Purchases

The Service may include virtual currency, items or other digital content ("Virtual Items"), some of which may be purchased with real money. Virtual Items have no monetary value, cannot be exchanged for real money or goods, and are licensed to you, not sold. Purchases are processed by the relevant app store, and refunds are handled under that store's policies. Except where required by law, all purchases are final. If you have a billing problem, please contact us within 30 days.

5. Acceptable Use

You agree not to: cheat, exploit bugs or use bots, scripts or other unauthorised software; copy, modify, reverse engineer or decompile the Service; interfere with or disrupt the Service or its servers; use the Service for any unlawful, harmful or fraudulent purpose; or harass, abuse or impersonate others. Any name, text or other content you submit must not be offensive, unlawful or infringe the rights of others, and you grant us a worldwide, royalty-free licence to use it in connection with the Service.

6. Intellectual Property

The Service and all of its content, including games, characters, artwork, music, software and trademarks, are owned by OZD or its licensors. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial entertainment.

7. Feedback

If you send us ideas, suggestions or other feedback, you agree that we may use it freely and without any obligation or compensation to you.

8. Suspension and Termination

We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have breached these Terms or applicable law. You may stop using the Service at any time. On termination, your licence to use the Service and any Virtual Items ends, and no refund will be due except where required by law. We may also modify or discontinue the Service, in whole or in part, at any time.

9. Advertising and Third-Party Services

The Service may display advertisements and may contain links to third-party websites or services, including rewarded ads that grant in-game benefits. We do not control and are not responsible for third-party content, products or services, and your dealings with them are solely between you and that third party. 10. Promotions

We may run contests, offers or giveaways from time to time. Additional rules may apply to each promotion and will be made available when it is announced.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including that the Service will be uninterrupted, error-free, secure or free of harmful components.

12. Limitation of Liability

To the fullest extent permitted by law, OZD will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 30 days before the claim arose. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnity

You agree to indemnify and hold OZD harmless from any claims, losses or expenses arising from your breach of these Terms or misuse of the Service.

Our Privacy Policy explains how we collect and use personal data and forms part of these Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Turkey. Before starting any formal proceedings, you agree to contact us at info@ozdconsult.com and give us 30 days to try to resolve the dispute informally. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey, unless mandatory consumer protection laws in your country of residence provide otherwise.

16. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page and change the "Last updated" date. Your continued use of the Service after changes take effect means you accept the updated Terms.

17. General

If any part of these Terms is found to be unenforceable, the rest will remain in effect. Our failure to enforce any right is not a waiver of it. You may not transfer your rights under these Terms without our consent; we may assign ours. These Terms are the entire agreement between you and OZD regarding the Service.
